Looking For A Good Attorney Can Be A Challenge

May 8th, 2010

I always thought that trying to find a lawyer would be an easy task. Boy was I wrong. Now let’s face it, I’m not out in “no mans land”, but still it was not easy. Here are some tips and tricks you might use in locating an attorney.

It seems like yesterday when I was trying to retain my first attorney, and I decided to utilize the reliable old “phone book”. I opened the phone book up to “counselors of law”, and found about five pages of names, corporate firms, legal and semi-legal practices and there were some paralegals listed as well. What a job this turned out to be, as I reached out to a few of the locations, and most of them wanted or better yet demanded, a significant binder.

They had to be kidding I initially thought. I mean I hadn’t even spoken with an attorney as of yet and all they wanted was my money. I thought that maybe this good old “yellow pages” strategy wasn’t as great as it was hyped up to be. I will start asking around was my next strategy, but this was also difficult.

My next decided course of action was to discuss my dilemma with some friends. I put everything into perspective, and realized that this was only a simple closing deal, so it was not as if I was uncovering some juicy gossip. Well my luck got better as they all knew “somebody” that was associated with a professional law firm in the immediate area. Better yet was the fact they they were able to steer me to somebody who specialized in real estate.

I realized afterward what a great move that was. It not only kept me and the family from having to visit each and every legal firm in close proximity in order to locate the “greatest lawyer”, but it made us feel better knowing that the recommendation came fro a bunch of friends that we had known for years and trusted at the same time. This really did turn out to be a time saver for us.

So probably the best advice I could give you right now in regards to searching for an attorney would be to ask around. Don’t be shy, just be straight forward and ask someone whom you trust their advice on who the “best attorney” might be. You might be glad you did.

.Again, we hope that you have success in finding a good attorney. If you attempt some of these tips, you should have much success.

Tesco Law

April 18th, 2010

Supermarket giant Tesco is in the process of launching it’s own range of legal services, after Lord Falconer’s call for an increase in cheap and accessible legal advice.

In addition to cheap will writing and storage services, Tesco Legal is also poised to offer a DIY divorce kit for less than ten pounds, which put an end to a marriage without the need for a solicitor or legal professional.

The well known chain is also looking at the possibility of introducing DIY letting agreements and bundles including any form required in order to start a limited company. These packs will be supplemented with a glossary of terms and an online Q&A service, which will help users with the often complex legalise.

Experts have suggested that Tesco Legal Store is the start of things to come and that going forward other high street chains will open their own legal services sections, with some implying there will be an even wider range of services available in this manner, especially after a reform in the rules previously governing law firms.

Once the july 2009 consultation document was, Lord Falconer suggested that the so called ‘Tesco law’ would be an exemplary example of the way legal advice can be offered to the public at a lower cost, although at the time Sir David Clementi, who lead the consultation, brushed off the idea and said he felt the term ‘Tesco law’ a distraction and a media folly.

Despite his misgivings though it does seem that the terms I catching on and that there will be an increase in the number of high street and Do It Yourself legal services, possibly leading to a decline in the numbers seeking professional legal advice, with some commentators expressing concern over the quality of this type of advice and urging those in need of legal representation to seek it from recommended solicitors practices.

Despite this though, The Law Society, whose members are likely to be most affected by the reform, have said that they see Tesco’s legal arm as an “innovative addition to the market”, suggesting that they see room for both types of legal advice in the market.

Top Five Tips When In Court

April 16th, 2010

Court can be a high stress experience, whether you’re new to it or have been before, but if you give these tips a read and bare them in mind on the day of your court appearance, you should feel more prepared and less stressed.

Keep an eye on the time: The first, and probably most important, rule of court attendance is to be on time. By arriving promptly you give you and your solicitor chance to go over any last minute details, meaning you feel calmer and more prepared. Punctuality also shows that you are taking the case and hearing seriously and are observing rules of the court.

Make sure you have the correct documents: Ensuring you have the right documentation with you is imperative, primarily because it can hold up the proceedings and even mean the case has to be adjourned. Furthermore having the correct documents suggests you are well prepared for court and are concerned about the outcome.

Right: Obviously knowing your rights is an important part of life and legal proceedings, but don’t become too dependent on them; just because something is your right it may not necessarily happen, and for some there’s nothing worse than a defendant constantly talking about their rights without addressing their responsibilities.

Mind your manners: The judge, jury, solicitors and officials are all aware that attending court can be a tension filled experience, but that doesn’t give those in court an excuse to be disrespectful. So try to remain calm and treat all those involved with politeness, as failing to do so could result in you being looked up on unfavourably.

Don’t count on winning: Despite thinking you’re in the right you may not win, so prepare yourself for the fact that the outcome may not go your way. It is also worth noting that in many cases it isn’t quite so black and white, with no definitive winner or loser as such. The key thing to focus on is having your case heard fairly and getting your views considered.

Unique Wedding Rings

February 12th, 2010

The practice of giving and wearing a wedding ring dates back thousands of years. A wedding ring symbolizes faithfulness and love between two people and are given on the day of a couple joining forces. Before the time that the knowledge of how to work metal became widely known, people used such things as plants, grass and even hair to ‘tie the knot’, which is what I think a wedding ring stands for.

These days a typical wedding ring might be made from precious metals such as gold, titanium, platinum or even white gold. Women’s wedding rings often contain a diamond, although sapphires are rapidly becoming more prevalent. Men’s wedding rings are frequently just a simple band of gold. There are many different styles of wedding rings, but the most popular for men is unquestionably the plain gold band.

For those who want something a bit more flamboyant, there are plenty of alternatives on the market. A man might want a more grandiose wedding ring, because it is frequently the only piece of jewellery that a man wears. Some alternatives to the plain band of gold are the Celtic Knot and the Claddagh gold rings.

It is essential for men’s wedding rings to be made from a robust alloy of gold. Most men do manual labour of one sort or another, even if it is only gardening, so it is a lot to ask of a pure gold wedding ring to last thirty or forty years.

A 14 or 18 carat gold ring will probably manage it, but a 22 carat ring would not. It would just wear away because it is too pure and consequently too soft. Platinum or titanium are much harder, although most people have a preference for gold.

In most countries tradition dictates that people wear their wedding ring on their left hand, although in a few countries such as Germany, Russia and Norway, people wear their wedding ring on the right hand.

Some couples would prefer to have a unique wedding ring and that is not so hard to accomplish as it might first appear to be. The simplest way to personalize your ring is to have an inscription like names and a date engraved on it.

Another way, would be to buy a precious stone separately and have the jeweller set it into the ring for you. The best alternative though is to find a jeweller you can trust and have him or her make up a pair of matching rings to your own design. I have done that and it is not a lot more expensive than a good ring.

Wearing matching wedding rings is a remarkable experience. People see that your ring is ’something different’ and many people ask, where you got them from. It all goes to help make that special day memorable for ever.

International And Inter-racial Dating

January 5th, 2010

This piece of writing is about my experiences of international and inter-racial dating. It is purely an account of what I have witnessed and experienced myself over the course of my life so far, although at 55 years old, I am nearer the end of it than the beginning. It is my advice on handling an international or inter-racial relationship.

It all began at an early age when I was in infant school at seven. There was a Filipina girl in our class and I could not take my eyes off her, although I probably did not know much about it then. We parted at eight when they moved closer to another school and I never saw her again.

My next meeting with a foreign girl, was the mademoiselle junior teacher at school and I was convinced that I would marry a French country girl when I grew up. That passed when the German assistant arrived.

When I was fourteen, I went on a school cruise to Leningrad and there was a party of exchange students going home to Sweden on the same ship. I went out with one of them for roughly a week and first realized the problems that can come from international dating. There was a minor language barrier, but it was fun getting over that. The real difficulty came, because I had predetermined ideas of what Swedish girls were like, probably instilled in me after years of silly ‘Carry On’ films.

At sixteen, I went to Germany to work for the summer and I found it very easy to get on with the German girls, although they were shyer that I was expecting too. Also an outlook I owed to silly Health and Efficiency ’sex films’.

After concluding university, I moved to The Netherlands to live. It was the seventies and Dutch girls were great. However, I made friends with male British colleagues first and soon saw some of the problems that can come from an international relationship. Most of the men I knew were typical Brits and made absolutely no effort to learn Dutch at all. Surprisingly, many Dutch people could not speak English either, particularly the parents.

This lead to a surprising number of stressful moments in a week and that put a lot of strain on my friends’ relationships. It is so easy to start name-calling when you are angry and it is the worst thing you can do. The Dutch girlfriend or her parents or friends would be called ‘a stupid cheese eater’ or something equally foolish and the relationship was over or in trouble for days. I do not remember what the Dutch called us.

I vowed to myself there and then never to get serious about a foreign girl because the arguments were just too much. Food was never a problem. Culture was not much of a problem, although where I was in southern Netherlands, most people were Catholic and I am not. This did perplex some parents but not me. Travelling was always going to be the drawback. Do you live by her parents or yours? Especially when children start arriving. Most countries have stronger family ties than Britain.

Then, at 50, having never been married, I went to Thailand, where I met my wife-to-be. Asian culture is very different from British or even European society and it is a real shock to both parties. Anyway, five years into our relationship and we are still fine. I recollect the reasons I gave myself for not marrying abroad when in The Netherlands and I was incorrect, but not much.

If you are going to enter into an international or even inter-racial relationship, you had better learn how to manage your anger. It is the most important advice you will ever get. Being understanding of other points of view is important too, but not getting angry is more important. Furthermore, you must try to learn something about your partner’s land, culture and language, otherwise you cannot join in any discussion your partner may have with someone who does know a bit about it.

I have never seen religion be a hindrance ever, except in an argument. My wife is Buddhist and I am not. We talk about it, but there is never any stress. Food, again I have never seen a problem in this area. Clothing, again no problem in my life. If you get into an international or inter-racial relationship, keep your temper, do not shout, do not get angry and talk things out calmly.

About Gay Unions

November 10th, 2009

The debate on gay marriages has been a very hot political subject for many years and because it is such a hot subject, the number of places that have come out publicly either for or against the subject is not surprising. While there are few states that allow gay or same-sex marriage, there are some that are more liberal, allowing almost equal rights. Massachusetts is currently the only state in the United States that allows same-sex marriages. The state of Rhode Island is generous enough to recognize as a legal marriage any same-sex marriage that was carried out in Massachusetts, which is considered a major victory by many same-sex supporters.

The elections of recent years have seen this as a very hot topic and with the White House stressing openly that marriage can only involve a man and a woman, not same-sexes, many states have been very reluctant to permit same-sex marriages. However, a few states have allowed same-sex civil unions, which are very similar to marriage.

These states are California, Connecticut, Hawaii, Maine, New Jersey, and Vermont. The District of Columbia also recognizes same-sex unions and the Governor of New Hampshire has stated publicly that he will soon sign a bill giving the go-ahead to same-sex unions. This is a major victory for those who support the movement.

While many states have not allowedf same-sex marriage, there are states that are sitting on the fence discussing the subject. Many couples who are fighting for their rights have pointed out that there is just no difference in the manner they run their households compared to their heterosexual counterparts. They have also pointed out that while they may be with a partner who is the same sex as them, they do still love their partner and should have the legal right to marry them too.

This has always been a contentious subject, and probably will continue to be a hot issue for several years in the future. While the issues rage within the states and at the national level, it will probably be quite a long time before the gay and lesbian rights groups can really declare a triumph for their cause. Nevertheless, there is some solace to be taken in the small triumphs as they occur, and another Governor of a state being ready to sanction a civil union is at least a move in the direction of triumph.

However, the fact is that the views of the individual states tend to reflect the opinions of the President. With a President in office who is a strict opponent of same-sex marriage and civil union, it is unlikely to allow much room for many more triumphs until a more accommodating, or rather liberal, President is in the White House. Only time will tell what President Obama’s views are.

After the bill has passed through all the legal channels of the state, it could go into effect as early as the next year, much to the joy of the New Hampshire residents, who have been waiting patiently. Each state that gives this right to its residents opens the door a little more to other states to become more tolerant. Finally, this paves the way for America to join most of Europe in recognizing the legal inequalities of straight and gay couples nationwide.

The First Date

October 28th, 2009

When you go on a date with someone there are certain things you should or should not do and certain ways you should behave. Of course you want the person to get to know you, so, first off, you oughtn’t attempt to be someone that you are not.

When you go out on a date you ought to look clean and dress nicely. This will show the other person, not only that you think about about your appearance, but that you also care about what they think about you. After all, If you don’t care about what the other person thinks, then you probably shouldn’t be going out on a date with them in the first place, should you?

This suggestion really depends on the person you are taking out. It applies more to a man dating a woman, obviously, but some women don’t like having doors opened for them either. You will have to judge it by ear. I think that the best guidance I can give, is that you should remember to open the car doors and all doors for that matter (except the washroom door) for your date, unless you are told or you sense otherwise.

A lot of younger women might say they wouldn’t judge a man by his door-opening behavior, but I think it does form a beneficial part of the overall picture she will be building up of you. However, if the woman you are going out with is an obvious feminist, then you had better let her open the doors for herself – just let her get on with it or it might trouble her. She might also want to pay for her own meal, but that’s not a bad thing is it?

Make sure that you on time. Be there when you say you will be there to pick her up and be ready to pay for the entire date. It may not come to that, she may buy a drink or two, but you can’t rely on it, so slip a credit card in your wallet too. Better safe than sorry and you don’t want to have walk home., would you?

So, that brings us neatly to the next point, which is, don’t take your date somewhere you cannot afford because you never want to find yourself asking your date for a loan to cover the bill, unless you don’t intend to see her again.

Another part of dating etiquette also relates to not making the other person feel as if they are on an interview. It is all too common for people on a date to ask too many questions because they want to get to know the other person quickly. However, how would you feel, if you were asked twenty questions between every course or drink? It is well-intentioned, but annoying. It is far better to have, say, half-a-dozen good, non-personal questions that you can discuss at more length.

If you push them too far, if you get too personal too quickly, you could scare them off. Just try to create a comfortable atmosphere by being considerate and yourself.
